EULA - End User License Agreement

Imazer Resizing Tool License Agreement

PLEASE CAREFULLY READ THE FOLLOWING BEFORE USING THE SOFTWARE BEING PROVIDED TO YOU. USING THE SOFTWARE INDICATES YOUR ACCEPTANCE OF EACH OF THE TERMS AND CONDITIONS CONTAINED IN THIS AGREEMENT. IF YOU DO NOT AGREE WITH WHAT THIS AGREEMENT SAYS, DO NOT USE THE SOFTWARE.

This License Agreement defines the terms and conditions under which you (the Licensee) are permitted by Exmont LLC (the Licensor) to use Imazer (the Software).

Freeware license

This Software is being distributed as Freeware. It may be freely used, copied and distributed as long as it is not sold, and all original files are included, including this license. The Licensee is NOT allowed to make a charge for distributing this Software (either for profit or merely to recover media and distribution costs) whether as a stand-alone product, or as part of a compilation or anthology, without explicit prior written permission. The Licensee may install and use an unlimited number of copies of this Software.

Copyright

Except where otherwise noted, all of the documentation and Software is copyrighted by the Licensor. The Licensor reserves all rights not expressly granted here.

Restrictions

The Licensee may not:

decode, modify, disassemble, change, alter, decompile, reverse engineer, make improvements to, or otherwise tamper with the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation;

rent, lease, sublicense or lend the Software, data, copies, related materials or your rights under this Agreement or allow access to the Software for unlicensed internal users;
alter, remove or obscure any proprietary legend, copyright or trademark notice contained in or on the Software, copies or related materials
Any such unauthorized se shall result in immediate and automatic termination of this Agreement and may result in criminal and/or civil prosecution.

Term of Agreement

The term of this Agreement shall commence at the time Licensee receives the Software and shall continue in effect indefinitely unless terminated as specified in Termination of Agreement, below.

Termination of Agreement

The Agreement will terminate automatically if Licensee fails to comply with the limitations described above. Upon termination of the Agreement, the Licensee shall either destroy all licensed copies of the Software, and all backups, or return them to Licensor. This obligation shall survive the termination of this Agreement.

DISCLAIMER OF WARRANTY

THIS SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY. THIS SOFTWARE IS PROVIDED WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES WHATSOEVER. BECAUSE OF THE DIVERSITY OF CONDITIONS AND HARDWARE UNDER WHICH THIS SOFTWARE MAY BE USED, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED. THE LICENSEE IS ADVISED TO TEST THE SOFTWARE THOROUGHLY BEFORE RELYING ON IT. THE LICENSEE MUST ASSUME THE ENTIRE RISK OF USING THE SOFTWARE.
